findalancer.com is an online tutoring marketplace operated by Capital Foundry (Pty) Ltd, a company registered in the Republic of South Africa ("we", "us", "our", or "the Platform"). The Platform connects students ("Students") with independent tutors ("Tutors") for live, one-on-one tutoring sessions conducted via the findalancer.com mobile application and web application at app.findalancer.com.
Capital Foundry (Pty) Ltd acts solely as an intermediary marketplace and technology provider. We do not employ Tutors and are not party to any tutoring arrangement between a Student and a Tutor. Tutors are independent contractors who set their own rates, availability, and teaching methods.
By registering an account, accessing, or using the findalancer.com Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional guidelines or policies referenced herein.
If you do not agree with any part of these Terms, you must not use the Platform.

By registering, you warrant that you meet all eligibility requirements. We reserve the right to suspend or terminate any account that does not meet these requirements.
You must create an account to access the Platform's core features. You agree to provide truthful and accurate information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@findalancer.com if you suspect any unauthorised access to your account.
Each individual may hold one Student account and one Tutor account. Creating duplicate or fraudulent accounts is prohibited and may result in immediate termination.
The Platform offers two account types: Student and Tutor. Registration is free for both. Tutor accounts are subject to the additional verification requirements described in Section 9.
Students may browse Tutor profiles, view availability, and book live tutoring sessions through the Platform. Bookings are confirmed upon successful deduction from the Student's in-app wallet.
Students must maintain a sufficient wallet balance to book sessions. Wallet funds may be loaded via Paystack (EFT, debit or credit card) or PayPal. Wallet balances are non-transferable between accounts.
Students must behave respectfully toward Tutors during sessions. Abusive, threatening, or inappropriate behaviour will result in session termination and may lead to account suspension. Students may not record sessions without the prior written consent of the Tutor.
Students may not contact Tutors outside the Platform to arrange sessions that bypass the booking system. Any attempt to circumvent the Platform's payment system is a material breach of these Terms and will result in immediate account termination.
Tutors operate as independent contractors. Nothing in these Terms creates an employment, agency, partnership, or joint venture relationship between a Tutor and Capital Foundry (Pty) Ltd. Tutors are solely responsible for their own tax obligations, including income tax and VAT registration where applicable.
Tutors must provide accurate information about their qualifications, experience, and subject expertise. Misrepresentation of credentials is a material breach of these Terms and may result in immediate account termination and legal action.
Tutors commit to providing professional, high-quality tutoring sessions as described in their profile. Tutors must honour confirmed bookings and provide adequate notice (minimum 24 hours) for any required cancellations.
Tutors may not solicit Students to pay for sessions outside the Platform. Any attempt to circumvent the Platform's payment system is a material breach of these Terms.
Tutors may withdraw earned funds (net of the platform commission) from their wallet to their nominated bank account via Paystack. Withdrawals are processed within 2–3 business days. Capital Foundry (Pty) Ltd reserves the right to hold funds pending verification of completed sessions or in the event of a dispute.
A booking is confirmed once the session fee has been deducted from the Student's wallet and the Tutor has accepted the booking. Both parties will receive a confirmation notification.
Sessions are conducted via the Platform's integrated live video system. Both parties agree to conduct sessions in an appropriate, private, and distraction-minimised environment.
If a Tutor fails to attend a confirmed session without prior notice, the Student will receive a full wallet credit. If a Student fails to attend, the session fee is forfeited unless a cancellation was submitted at least 24 hours in advance.
Tutors may set assignments through the Platform's built-in assignment tool. Assignments are subject to the same Platform terms. Tutors may not charge additional fees for assignments set through the Platform.
Capital Foundry (Pty) Ltd charges Tutors a 10% commission on the gross value of each completed session. This amount is automatically deducted before earnings are credited to the Tutor's wallet.
Tutors set their own per-session rates. All rates displayed on the Platform are in South African Rand (ZAR) and are inclusive of any applicable taxes unless otherwise stated.
Payment processing is provided by Paystack (Flutterwave Technology Solutions Ltd) and PayPal. By adding funds to your wallet, you agree to the applicable payment provider's terms and conditions. Capital Foundry (Pty) Ltd does not store card or banking details.
Student wallet funds represent a prepaid balance held by Capital Foundry (Pty) Ltd for the purpose of booking sessions. Wallet balances do not earn interest and are non-refundable except where required by applicable South African consumer protection law.
Tutors are solely responsible for declaring and paying all taxes on income earned through the Platform. Capital Foundry (Pty) Ltd does not withhold income tax on behalf of Tutors.
To maintain a Verified Tutor badge on the Platform, Tutors are required to complete the annual verification process and pay the annual verification fee of R299 per year.

Verification is reviewed and approved by the findalancer.com team. Approval is not guaranteed and may be declined at our discretion. Verification fees are non-refundable once the review process has commenced.
Tutors who do not renew annual verification will have their Verified badge removed and may have reduced profile visibility on the Platform.
Students may cancel a confirmed booking:
If a Tutor cancels a confirmed session, the Student receives a full wallet credit. Repeated cancellations by a Tutor may result in account suspension or removal from the Platform.
Unused wallet balances are generally non-refundable to the original payment method. Exceptions may be made at our discretion for account closures or where required by the Consumer Protection Act 68 of 2008.
Session quality disputes should be raised within 48 hours of the session via support@findalancer.com. We will review the matter and may issue a partial or full wallet credit at our sole discretion. Capital Foundry (Pty) Ltd's decision on disputes is final.
You may not use the Platform to:
Breach of this section may result in immediate account suspension, termination, and referral to law enforcement where applicable.
All intellectual property in the findalancer.com Platform — including the software, design system, logo, trademarks, and content produced by Capital Foundry (Pty) Ltd — is owned exclusively by Capital Foundry (Pty) Ltd. You may not copy, reproduce, modify, distribute, or create derivative works from any Platform IP without our prior written consent.
You retain ownership of content you submit to the Platform (e.g. profile information, messages, assignment content). By submitting content, you grant Capital Foundry (Pty) Ltd a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce that content for the purpose of operating and improving the Platform.
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by Capital Foundry (Pty) Ltd without restriction or compensation.
Capital Foundry (Pty) Ltd provides a technology platform connecting Students and Tutors. We do not guarantee the quality, accuracy, or fitness for purpose of any tutoring session, Tutor qualification, or educational outcome.
We strive for high availability but do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to suspend the Platform for maintenance at any time.
To the maximum extent permitted by South African law, Capital Foundry (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of earnings, loss of data, or loss of opportunity.
Our total aggregate liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total session fees paid by you in the 3 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the Consumer Protection Act 68 of 2008 or other applicable South African legislation.
We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or pose a risk to other users or the Platform.
You may close your account at any time by contacting support@findalancer.com. Upon account closure, unused Student wallet balances are forfeited unless a refund is required under applicable law. Tutor wallet balances representing completed, undisputed session earnings will be paid out within 14 business days of account closure.
Sections 8, 11, 12, 13, and 15 survive termination of your account.
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or related to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts.
Before initiating any legal proceedings, you agree to attempt in good faith to resolve any dispute by contacting us at legal@findalancer.com. We will endeavour to respond within 10 business days.
We reserve the right to amend these Terms at any time. When we make material changes, we will notify registered users via email or in-app notification at least 14 days before the changes take effect. Continued use of the Platform after that date constitutes acceptance of the updated Terms.
